A Gestational Carrier Agreement is a contract between Intended Parents, Surrogate and her partner/spouse, if applicable. These agreements are binding contracts that act as a roadmap for the process of baby making outside the bedroom. It will set forth the Parties' rights, obligations, intentions and expectations. The agreement binds the Parties on important issues including compensation, future custody, delivery and medical decisions, future contact and obligations such as expenses and insurance (both health and life). The Gestational Carrier Agreement is negotiated once the Intended Parents and the Surrogate have been matched; all screening is complete and all medical issues have been addressed by the health care provider.
